    8 Steps to Take Before Filing for Divorce

    Divorce is one of the emotional aspects of being in a relationship. It doesn’t just affect you and your partner, but also the other people around, including the kids. Whether the decision to become unmarried is mutual or issues are being discussed, everyone should be aware of their rights, especially to ensure that their future will still be stable even if they’re no longer together.

    However, before the divorce process starts, you should also be aware of the things you need to prepare. Besides, the choice you make at the early stage of divorce can significantly affect the whole process, and even the results.

    In this article, we’ll discuss the steps to take before filing for divorce.

    1. Reflect Before Deciding

    Before filing for divorce, you should first reflect on the decisions you’re about to make. You can discuss it with your spouse if you can. Try visiting a marriage counsellor, take a hobby together, and do any other things that you can to save your marriage.

    It can be an emotional phase, but at least you both tried to work things out before deciding whether you want to continue with filing for divorce. Besides, acting impulsively won’t solve anything, and both of you might end up getting hurt.

    2. Understand Your Legal Options

    Divorce laws vary from one location to another. So, if you’re planning to file for divorce, it’s best if you’re aware of your legal options based on the local divorce laws. You can look for family lawyers, research the rules, acceptable grounds, and waiting period.

    In some areas, the “no-fault” divorce is also recognised, wherein both parties are at no fault, and they just don’t want to be together anymore. Fortunately, if you have this kind of law in your area, you can have a smoother transition.

    3. Gather Essential Documents

    Once you know the requirements for the divorce in your area, you can gather them gradually. It’s best to gather all the essential documents as early as possible, including the bank statements, tax returns, investments, and property records. These things are essential so that there won’t be issues in the future.

    At the same time, if you have complete records of all these essential documents, you can consult with family lawyers to assess your situation.

    Before filing for divorce, you should ensure that you’re financially independent, even for at least a few months, until you can find a way to be stable again. You can open a separate bank account and put all your personal funds there.     On the other hand, if your financial assets are limited, ensure to at least cover the cost of the essentials.

    5. Prioritise Your Children’s Well-being

    If you have kids, discussing the divorce before any step should be one of your priorities. At the same time, you should also know the best way to tell them about it. You can ask for professional help when it comes to the words you’re going to use, especially since the announcement can significantly impact their whole lives.

    Aside from telling the kids about the divorce, you should also discuss the living and co-parenting arrangements, so that there won’t be misunderstandings once the divorce is finalised.

    6. Build a Support System

    Divorce can be messy due to various emotional, financial issues, and other concerns. And even if you think you can handle things well, it’s easier to have a support system throughout this process. Besides, you don’t have to face everything all alone. You can talk to your family or friends about what you’re going through.

    On the other hand, if you can’t talk to them, at least have a therapist to talk to, so that you won’t feel left alone, and you can still be confident while handling your case.

    Aside from the co-parenting arrangements, you should also plan your living arrangements. In some cases, one of you might find it hard to look for a new place, so things can be a bit more complicated. You can help each other out in terms of finding a new place for the other that can be emotionally helpful and financially sustainable.

    8. Stay Calm and Respectful

    At the time when things can get a bit emotional for both parties, you might end up saying things you don’t mean. And it’s not just about the verbal cues. In some cases, people also post on social media and tell other people bad things about their spouses. Unfortunately, this may end up in a messy divorce. So, as much as possible, stay calm and respectful to each other.

    Filing for a divorce is more than just following the legal matters of ending a marriage. It’s also about taking another step that can change lives forever. So, before doing so, it’s best if you can prepare thoroughly, so that things won’t get messy moving forward.
